The Personnel Faction considers the UGY project both an opportunity and a challenge of tremendous proportions. At the same time, media attention for the project has led to overwhelming interest among staff members, including frequent utterances of skepticism vis-à-vis the project. Therefore, in the light of accelerating developments, the Personnel Faction seeks to maximize guarantees for success by submitting further questions to the Board for discussion at the University Council of 30 April 2015:

1. A delegation of the Chinese parties visited the RUG for some days during Easter: Can the Board deliver a report about this visit, both its formal and informal aspects? [ this question was not asked since the Board addressed this matter in its opening statement ]

2. Did the Board ponder the possibility of involving Wageningen University in the project?

3. We have learned that Wageningen University was approached with a similar offer but turned it down. Has the board contacted Wageningen University to find out if their reasons to turn down the offer might also apply to the UG situation? Here we do not only mean the reasons that have been mentioned in media reports. 

4. What are the major dates of the timeline of the UGY project until 2020? In particular: (a) What is the next step? (b) When would a contract be signed (“the Effective Date”)? (c) When would UGY start its educational program?

5. What is the role of the co-governance in the UGY project at its various stages? That is, both in this decision-making process and in the Yantai situation itself. Can the Board give its view on how it interprets the Law on Higher Education and Scientific Research (WHW) in this respect?

6. The Board has stated that the UGY project would not draw financial resources from the regular RUG budget, which implies that a possible failure of UGY would not affect the course of events at the domestic RUG campuses. Can the Board reconfirm this view and clarify how it is guaranteed in the UGY project?

7. Since UG staff now located at Groningen has to be allocated to UGY on a temporary basis, how does the Board think to fill temporary vacancies created at Groningen in this way? Can the Board guarantee that this will not lead to creeping increases of workload for the remaining staff?

8. Has the Board developed ideas about how minimum guarantees for the academic freedom and freedom of expression of the staff and students will play a role in the go/no go-decision for the UGY project?

9. Considering all of the above, which set of criteria the Board intends to apply to a go/no go decision?

10. Given the magnitude of the entire project, has the board considered to ask for any form of risk analysis of the UGY project by an independent party, perhaps one specifically to ensure that the data on these go-no go criteria is as solid and reliable as possible at the moment of go-no go? If not, why not?

11. Until now, staff and students have been informed about the UGY project via the media. Is it not time to start a regular series of news reports to inform the RUG community about the UGY project directly?

12. De eerste vraag heeft betrekking op het ‘kopie-karakter’ van de Yantai branch van de RUG. Enerzijds laat de RUG niet na om te onderstrepen dat de UGY een kopie van de RUG zal zijn, maar in meer specifieke zin lijkt het er meer op dat we moeten denken aan een kopie van slechts twee faculteiten van de RUG (FWN en FEB) – en niet van de andere faculteiten, waarmee de UGY dus geen kopie van de RUG zou zijn. Het zou verhelderend werken als we weten waar het over gaat, wat de ideeën van het CvB zijn met betrekking tot dit ‘kopie-karakter’.

13. Verwant is een vraag die betrekking heeft op wat de RUG precies in Yantai gaat brengen: we hebben van het CvB begrepen dat de RUG bestaande Engelstalige, geaccrediteerde opleidingen gaat aanbieden. We zouden zou graag weten of dit correct is. Vervolgens zouden we graag weten of dit betekent dat die opleidingen onder dezelfde CROHO-code in Yantai worden gegeven.

14. Wat mij toch als jurist van het hart moet: er zijn situaties denkbaar waarin de wetgeving van een bepaald land prevaleert boven de wetgeving van het gastland, denk bijvoorbeeld aan diplomatieke missies en schepen. Dat beide typen wetgeving – die van het vreemde land en van het gastland - beide van toepassing zijn is mijns inziens een novum, dat bovendien uitnodigt tot moeilijkheden. Het is lijkt mij eenvoudiger om een heel fysiek gebied zoals een campus onder één juridisch regiem te brengen en daar met het gastland een verdrag over te sluiten.

15. Ons voorlaatste punt heeft betrekking op de organisatie van de medezeggenschap in de UGY. Onze huidige wetgeving gaat er vanuit dat iedere faculteit een faculteitsraad heeft, en zolang dat niet zo is, de Universiteitsraad fungeert als Faculteitsraad van de betreffende faculteit. Dat laatste lijkt ons in Yantai op problemen te stuiten die samenhangen met de afstand tussen Groningen en Yantai. Graag vernamen wij van het College een visie over hoe om te gaan met dit punt.  

16. Het laatste punt dat ik wil noemen heeft betrekking op wat er precies start op 1 september 2017. Begint de RUG dan met het aanbieden van het eerste jaar van een opleiding – of begint de RUG tegelijkertijd met het aanbieden van een masteropleiding vanuit de Bologna gedachte dat een bachelor en een master niet rechtstreeks op elkaar hoeven aan te sluiten?
